1. Agreement to Terms
By accessing or using CekapAI's website (www.cekapai.my) and AML screening platform (“Services”), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Services.
2. Description of Services
CekapAI provides AI-powered anti-money laundering (AML) screening, entity risk assessment, case management, and compliance reporting tools. Our Services are designed to assist — not replace — your compliance team's decision-making process.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your credentials
- You must notify us immediately of any unauthorised access to your account
- You must be at least 18 years old and have authority to bind your organisation
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract our AI models or proprietary algorithms
- Share your account credentials with unauthorised third parties
- Interfere with or disrupt the integrity or performance of the Services
- Use the Services to build a competing product
5. Data and Privacy
Your use of the Services is also governed by our Privacy Policy. You are responsible for ensuring that any personal data you submit for screening has been collected in compliance with applicable data protection laws, including PDPA Malaysia.
6. Pricing and Payment
- Pricing is as displayed on our website or as agreed in your subscription agreement
- Fees are billed monthly or annually depending on your plan
- Overages beyond your plan's included entities are billed at the published overage rate
- All fees are non-refundable unless otherwise stated
- We reserve the right to modify pricing with 30 days' notice
7. Service Levels
Service level commitments (uptime SLAs) vary by plan and are specified in your subscription agreement. We will use commercially reasonable efforts to maintain platform availability.
8. Intellectual Property
All rights, title, and interest in the Services, including our AI models, algorithms, software, and documentation, remain the property of CekapAI. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Services during your subscription term.
9. Disclaimers
The Services provide screening results and risk assessments as decision-support tools. They do not constitute legal, regulatory, or compliance advice.
You remain solely responsible for all compliance decisions, regulatory filings, and reporting obligations.
While we strive for accuracy, AI-generated results may contain errors. All screening outcomes should be reviewed by qualified compliance personnel.
10. Limitation of Liability
To the maximum extent permitted by law, CekapAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services.
11. Termination
- You may cancel your account at any time through the platform or by contacting us
- We may suspend or terminate your access for breach of these Terms
- Upon termination, your right to use the Services ceases immediately
- Data retention after termination follows the periods outlined in our Privacy Policy
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Services after changes constitutes acceptance of the revised Terms.
